Terms and Conditions
1.2. We retain the right to alter this Agreement at any moment, by making these changes to this Agreement on the Website at least seven (7) days before the change comes into effect, during which timeframe you may reject the changes by closing your account. Your continued utilization of the Website and/or our Services after any such change represents your acceptance of the amended Agreement.
1.3. For the purposes of this Agreement, the following definitions shall apply:
1.3.2. ATS or Applicant Tracking Systems: software application that allows electronic handling of recruitment requirements operated by third parties

Womenforhire Content: the content, information, and data displayed on the Website or otherwise disclosed by Womenforhire to You in conjunction with the provision of the Services, including job postings without limitation, ATS, employer and company data, recruiter information, advertisements, links, reports, contents of third-party users, and other

Womenforhire Data: the Services and all materials therein or transferred thereby or otherwise displayed or available at the Website, including, without limitation, software, images, text, graphics, illustrations, photographs, audio, videos, music, and other content, logos, brands, trade and service marks (including in particular Womenforhire and jobs.womenforhire.com), patents and copyrights and all Intellectual Property Rights related thereto.
1.3.6. Profile Settings: the user preferences editor page available on our Website when you are logged in your account.
1.3.7. Services: the job-related services provided on the Website with or without registration or after registration to the Website
1.3.8. User, You or Your: any individual visiting the Website and/or registering to the Website and to our Services (including co-registration) and/or using our Services with or without registration.
1.3.9. User Content: any visual or textual or other (audio, etc.) content posted or submitted by a User on our Website, such as without limitation in blogs, groups, communities and other similar forums and surfaces or otherwise disclosed to Womenforhire.
1.3.10. User Data: Personal Data and User Content together.
1.3.11. Third-Party Sites: other sites operated by third parties such as, without limitation, advertisings, employer and recruiter websites, other job boards, including the information, materials, products, or services displayed or provided thereon.
2. Ownership Rights
2.1 Except for content owned by or licensed from third parties, the Services and all materials therein or transferred thereby or otherwise displayed or available at the Website, including software, images, text, graphics, illustrations, photographs, audio, videos, music, other content, logos, brands, trade and service marks (especially featuring Womenforhire, Womenforhire.com), patents and copyrights (“Womenforhire Content”), along with all Intellectual Property Rights related thereto, are the exclusive property of Womenforhire.
2.2 Unless explicitly provided for in this Agreement, nothing shall be deemed to create a license for any such Intellectual Property Rights. You agree not to engage in the sale, license, rent, modification, distribution, copying, reproduction, transmission, public display, public performance, publication, adapt, edit, or creation of derivative works from any Womenforhire Content. The use of the Womenforhire Content or materials on the Services for any purpose not clearly allowed by this Agreement is strictly forbidden.
3. General Principles of Using the Website and the Services
3.1 Accepted Use
3.1.1 You may utilize our Website and Services for your personal objectives to seek and apply for jobs, in accordance with the stipulations of this Agreement.
3.1.2 In addition to any other type of use that is forbidden or otherwise inconsistent with the rules or the overall purpose of this Agreement, you shall not:
- Grant access to the Services to third parties by means of re-licensing, renting, leasing, or any other method; you may not enable or permit the reverse engineering, disassembly, or decompilation of these Services; you may not use the Services in any way to design or develop concurrent services and/or software products or to create derivative works of the Services;
- Copy, distribute or expose any segment of the Services through any medium, including without limitation by any automated or non-automated “scraping”;
- Utilize any automated system, such as but not limited to “robots,” “spiders,” “offline readers,” etc., to access the Services in a way that transmits more server request messages to the Womenforhire.com than a single individual could generate within the same timeframe using a regular online web browser;
- Transmit unsolicited email, spam, or chain letters;
- Interfere with, jeopardize the system safety or decipher any transmissions to or from the servers running the Services;
- Carry out any action that imposes, or may impose, based on our sole discretion, a disproportionate or unreasonable burden on our infrastructure;
- Upload invalid data, viruses, worms, or other software agents to the Services;
- Harvest or collect any personally identifiable data from the Website or the Services, except as explicitly allowed by the Services’ features;
- Utilize the Services for any commercial solicitation objectives;
- Impersonate another individual, conduct fraud, hide or attempt to hide your identity;
- Interfere with the Services’ proper functioning;
- Access any content on the Services via any technology or means other than those provided or sanctioned by the Services; or
- Circumvent the measures we may utilize to prevent or limit access to the Services, including without limitation features that hinder or restrict use or copying of any content or enforce constraints on use of the Services or the content therein.
- Mine, harvest, spider, display, extract, or otherwise utilize any User Data on or from the Website except Your User Data.
3.1.3 Womenforhire grants revocable permission to public search engines to copy certain User Data from the Website for the sole purpose of creating publicly accessible searchable indices of such data, but not to cache or archive such data.
3.1.4. Only if you are at least eighteen (18) years of age and can form a legally binding contract with Womenforhire.com, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules, and regulations, can you use our Services. The use or access of the Services by anyone under the age of 18 is prohibited and a violation of this Agreement.
3.2. Functionality of the Website and Provision of the Services
3.2.1. Womenforhire reserves the right to partially or entirely deny or terminate access to parts or the entirety of the Website or the Services at its discretion and without prior notice or explanation. Additionally, Womenforhire may update the Website or the Services or temporarily or permanently stop the operation of the Website or provision of the Services.
3.2.2. The content, data, and information displayed on the Website or otherwise disclosed by Womenforhire to you in relation to the provision of the Services, including without limitation, job postings, ATS, employer and company data, recruiter information, advertisements, links, reports, User Data of other users, etc. (“Womenforhire Data”) is provided without warranties of any sort, including any implied or express warranty that such Womenforhire Data is up to date, truthful, precise, dependable, legally compliant, non-infringing, non-misleading or otherwise not objectionable, or that any errors or defects will be corrected. We will not be liable to you (whether under contract law, tort law, or otherwise) for any direct, indirect, special, or consequential loss; or for any business losses, loss of income, revenue, anticipated savings, or profits, loss of contracts or business relationships, loss of reputation or goodwill, which may result from the fact that said Womenforhire Data is inaccurate, untruthful, outdated, unreliable, legally non-compliant, infringing, misleading, or otherwise objectionable or that any defects or errors are not corrected. Your dealings with advertisers and other third parties, whose contents are displayed on our Website or otherwise given to you, including delivery and payment of goods, services, and any other terms (such as warranties) are solely between you and such third parties. You agree that we shall not be held responsible for any damage or loss of any kind relating to your dealings with such third parties.
3.2.3. We are not liable for your interactions with other users, or any user’s inaction or action. We are not obligated to enforce this Agreement against any other user on your behalf.
3.2.4. We hold the right, though bear no obligation, to oversee your User Data and your usage of our Website and our Services. We hold the right to suspend or terminate your use of the Website and the Services and to remove any User Data without providing notice or reasons.
3.3. User Data
3.3.2. You declare and warranty that you possess all the rights, power and authority needed to grant the rights granted herein to any User Data, that Womenforhire’s use of your User Data in accordance with this Agreement will not violate any law or infringe the rights of any third party.
3.3.3. You are solely accountable for the User Data that you post, submit or otherwise disclosed to us. You agree not to post User Data that:
– May create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to You, to any other User or any other individual, or to any animal;
– May generate a risk of any other loss or damage to any person or property;
– Seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
– May constitute or contribute to a crime or tort;
– Contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable;
– Contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets, information subject to any confidentiality or non-compete obligation, information infringing intellectual property rights, privacy or data protection rules, etc.);
– Contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or
– Contains any information or content that you know is not correct and current.
3.3.4. By posting or submitting on the Website, or otherwise disclosing to us User Data, you represent and warrant that it is up to date, truthful, precise, dependable, legally compliant, non-infringing, non-misleading or otherwise not objectionable. You shall indemnify Womenforhire (whether under contract law, tort law, or otherwise) for any direct, indirect, special or consequential loss; or for any business losses, loss of income, revenue, anticipated savings, or profits, loss of contracts or business relationships, loss of reputation or goodwill, which may arise from the fact that User Data that you post, submit or otherwise disclose is inaccurate, untruthful, outdated, unreliable, legally non-compliant, infringing, misleading or otherwise objectionable.
3.3.5. You comprehend and agree that You may be exposed to User Data that is inaccurate, objectionable, or otherwise unsuitable to your purpose, and you consent that Womenforhire shall bear no liability for any damages you claim to incur as a result of any such User Data.
4. Job Queries
4.1. Users are permitted to conduct job inquiries on the Womenforhire website either with an active account or as a guest. Your historic search data will be utilized to deliver tailor-made Job Notifications and Instant Matches.
4.2. Womenforhire disclaims all liability concerning the functioning of the job search platform and the thoroughness, pertinence or suitability of the results generated.
5. Job Application Procedure
5.1. Users may respond to job openings displayed on the Womenforhire website either with a registered account or anonymously (internal application procedure). Upon application submission, pertinent User Information required for the application process will be shared with the concerned employer/recruiter or Applicant Tracking Systems (ATS) related to the job opening. Users are liable for the upkeep and accuracy of their resume/CV associated with their account each time an application is made for an advertised job. The guidelines regarding User Information in clause 3.3 are equally applicable in cases of anonymous applications.
5.2. Womenforhire makes concerted efforts to ensure that the employer/recruiter or ATS posting the job receives the User Information submitted with your application, but this cannot be guaranteed. Hence, we disclaim any liability if the concerned employer/recruiter or ATS fails to receive your application and/or the submitted User Information, or if your application or the submitted User Information is refused. In case of transmission failure of your application/user data, Womenforhire may, but is not obligated to, attempt a re-transmission. The guidelines regarding User Information in clause 3.3 are equally applicable if your application or User Information has not been received or has been rejected by the job-posting employer/recruiter or ATS.
5.3. By applying to job opportunities posted by third-party Applicant Tracking Systems (ATS), users express consent to allow Womenforhire to register their User Information and User content in the ATS, under their name and on their behalf, for consideration in future job opportunities managed by the ATS.
5.4. Some job postings on the Womenforhire site are links to job listings carried on Third-Party Sites. By clicking on these links, users would be redirected to these Third-Party Sites where they can submit applications (external application procedure). The terms laid out in point 3.2.2 and 3.2.5 are applicable primarily to our linkage to, and your visitation or utilization of, such Third-Party Sites.
6. Indemnification and Equitable Remedies
6.1. Within the maximum scope permitted by relevant law, you agree to protect, hold harmless and indemnify Womenforhire, including its subsidiaries and their respective directors, officers, board members, agents, employees, successors and assigns, against any claims, damages, liabilities, obligations, losses, expenses, legal fees (inclusive of all associated costs) emanating from: (i) your utilization of and access to the Womenforhire website and services, inclusive of any User Information sent or received by you; (ii) your infringement of any term of this Agreement or any other agreement you have with Womenforhire, especially your violation of any of the representations and warranties mentioned herein; (iii) your violation of any third-party rights, specifically any privacy rights or intellectual property rights; (iv) your noncompliance with any applicable laws, regulations, or rules; (v) claims or damages resulting from your User Data; (vi) other parties accessing and using the Womenforhire site and Services with your account credentials; (vii) your intentional misconduct or negligence.
6.2. You acknowledge that your violation of any provision set out in this Agreement could cause irreparable harm to Womenforhire, for which monetary compensation may not suffice. As a result, Womenforhire may initiate a lawsuit to prevent you from any actions contravening these clauses, a remedy that is cumulative and non-exclusive. Furthermore, Womenforhire may seek an injunction restraining any breach or impending breach of these provisions, besides any other relief to which Womenforhire may be entitled both by law or in equity.
7. DISCLAIMER OF WARRANTY
7.1. EXCEPT AS SPECIFICALLY STATED IN THIS AGREEMENT AND IN COMPLIANCE WITH APPLICABLE LAW, WOMENFORHIRE OPERATES ITS SITE AND OFFERS SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE GREATEST EXTENT ALLOWED BY APPLICABLE LAW, THE OPERATION OF THIS SITE AND PROVISION OF SERVICES ARE CONDUCTED WITHOUT WARRANTIES, CONDITIONS OR TERMS OF ANY SORT, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A SPECIFIC PURPOSE, OR NON-INFRINGEMENT. WOMENFORHIRE, ITS EMPLOYEES, OR AGENTS DO NOT PROVIDE ANY ADVICE OR INFORMATION, BE IT ORAL OR WRITTEN, THAT CREATES A WARRANTY, TERM, OR CONDITION NOT EXPRESSLY OUTLINED HEREIN. TO ELABORATE, WE DO NOT GUARANTEE THAT: (i) ANY CONTENT PROVIDED ON THE WEBSITE OR THROUGH THE SERVICES IS ACCURATE, LEGALLY COMPLIANT, CURRENT, RELIABLE OR CORRECT; (ii) THE SERVICES WILL MEET YOUR REQUIREMENTS; (iii) THE SERVICES WILL BE AVAILABLE AT A PARTICULAR TIME OR LOCATION, UNINTERRUPTED, OR SECURE; (iv) ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR (v) THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. ANY CONTENT DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES IS AT YOUR OWN RISK, AND YOU WILL BE ENTIRELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA OR ANY OTHER TYPE OF LOSS THAT RESULTS FROM SUCH CONTENT OR YOUR USE OF THE SERVICES.
7.2. WOMENFORHIRE DOES NOT WARRANTY, ENDORSE, GUARANTEE, OR ASSUME LIABILITY FOR ANY PRODUCT OR SERVICE PROMOTED OR OFFERED BY A USER OR THIRD PARTY ON THE SITE OR THROUGH THE SERVICES OR ANY HYPERLINKED WEBSITE OR SERVICE, AND WOMENFORHIRE WILL NOT BE INVOLVED IN OR MONITOR ANY TRANSACTION BETWEEN YOU AND USERS OR THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.
7.3. WOMENFORHIRE DOES NOT WARRANTY THAT YOUR ACCESS TO AND USE OF THE SITE AND THE SERVICES WILL COMPLY WITH OR ENSURE ADHERENCE TO ANY LEGAL OBLIGATIONS, LAWS OR REGULATIONS.
8. LIMITATION OF LIABILITY
8.1. SUBJECT TO THE MAXIMUM EXTENT PERMISSIBLE BY LEGISLATION AND UNLESS OTHERWISE EXPRESSLY OUTLINED HEREIN, UNDER NO CIRCUMSTANCES SHALL WOMENFORHIRE, ITS SUBSIDIARIES, THEIR RESPECTIVE BOARD MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNEES BE HELD LIABLE TO YOU WHETHER IN TERMS OF CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE OR LOSS, LOSS OF PROFITS, GOODWILL, USE, OR DATA THAT ARISE FROM THE USE OF, OR FAILURE TO USE, THE SERVICES. WOMENFORHIRE WILL NOT BE ACCOUNTABLE UNDER ANY SITUATION FOR DAMAGE, LOSS OR INJURY STEMMING FROM HACKING, TAMPERING OR UNAUTHORISED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
8.2. SUBJECT TO THE FULLEST EXTENT ALLOWABLE BY LAW, WOMENFORHIRE ABSOLVES ITSELF OF LIABILITY OR RESPONSIBILITY FOR ANY ERROR, MISTAKE, OR INACCURACY OF CONTENT; ANY PERSONAL INJURY OR PROPERTY DAMAGE THAT MAY BE INCURRED AS A RESULT OF ACCESSING OR USING THE SERVICES; ANY UNAUTHORISED ACCESS TO OR USE OF OUR SYSTEMS OR SERVERS AND/OR ANY PERSONAL INFORMATION STORED WITHIN; ANY INTERRUPTION OR TERMINATION OF TRANSMISSION TO OR FROM THE SERVICES; ANY BUGS, VIRUSES, TROJAN HORSES OR SIMILAR ATTACKS THAT MAY BE TRANSMITTED BY ANY THIRD PARTY TO OR THROUGH THE SERVICES; ANY ERRORS OR OMISSIONS IN CONTENT OR LOSS OR DAMAGE RESULTING FROM THE USE OF CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE AVAILABLE THROUGH THE SERVICES; USER CONTENT; OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL ACTIONS OF ANY USER OR THIRD PARTY.
8.3. THIS LIMITATION OF LIABILITY CLAUSE APPLIES REGARDLESS OF THE BASIS OF THE ALLEGED LIABILITY (WHETHER CONTRACTUAL, TORT, NEGLIGENCE, STRICT LIABILITY, OR BREACH OF STATUTORY DUTY), EVEN IF WOMENFORHIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OCCURRING.

10. ADDITIONAL PROVISIONS
10.1. All matters concerning this Agreement and any dispute or claim resulting from or associated with it (including non-contractual disputes or claims), will be governed by and interpreted according to the internal laws of the state of Delaware, void of any impact from any choice or conflict of law provision or rule (whether of the state of Delaware or other jurisdiction). Any legal proceedings deriving from or relevant to this Agreement shall exclusively take place within the federal courts of the United States for the district of Delaware or the courts of the state of Delaware, albeit we keep the right to initiate any legal action against you for breach of this Agreement in your country of residence or any other pertinent country. You forfeit any objections to such courts exercising jurisdiction over you and venue in these courts.
10.2. You agree to receiving all notices either via currently held on file with Womenforhire. In any case, delivery deemed to have taken place five (5) days after the date it was dispatched.
10.3. Notifying Womenforhire requires sending an email to info (at) womenforhire (dot) com.
10.4. This Agreement cannot be assigned by you for any reason. Any such attempted assignment will be deemed invalid and a breach of this Agreement.
10.5. Both parties shall remain independent in this Agreement. Nothing in this Agreement will constitute a partnership, joint venture, or agency relationship between both parties. Neither party will have the right to obligate or bind the other to any third party.
10.6. Any invalid or unenforceable provision in this Agreement does not affect the remaining provisions; they will remain in full force.
10.7. The waiver by either party concerning any default or breach of this Agreement does not constitute a waiver of any other or subsequent default or breach.
10.9. In the instance where either party employs attorneys to enforce any rights emanating from or relevant to this Agreement, the prevailing party will be allowed to recover reasonable attorney’s fees from the other.
